The Land of Enchantment, in just a few hours, will become the 19th state to allow adults with a valid I.D. to purchase cannabis products without a medical prescription.

Although the change significantly loosens up the sale of cannabis, it doesn’t mean EVERYTHING is legal. Here are a few of the ways dancing with Mary Jane could still put you on the wrong side of the law:

  • Transporting your legally-purchased weed across state lines is still a no-no.  This is especially important as many El Paso residents are eager to use the looser laws to purchase what New Mexico dispensaries have to offer. To be extra, extra clear: YOU CAN STILL GET IN TROUBLE FOR BUYING POT IN NEW MEXICO AND BRINGING IT BACK TO TEXAS.
  • In New Mexico, public possession of over 8 ounces is still a felony.
  • Possession of school property, including daycares, is a misdemeanor.
  • DRIVING under the influence of cannabis IS STILL AGAINST THE LAW
  • Under-age possession (ages 18-21) is a civil penalty. SELLING to minors under the age of 18 IS A FELONY.
  • (As a side-note on this one: the science of the effects of marijuana on brain development is still…a matter of debate. Some of the science suggests that cannabis use can affect brain development even in adults in their mid-20s. There’s still a LOT of unsettled science over this issue.)
