What do Tom Petty and Sam Smith have in common? You might think the answer to that question is 'nothing,' but according to a handful of listeners their songs 'I Won't Back Down' and 'Stay With Me,' respectively, sound eerily similar. New details have emerged that the two actually settled a case out of court that awarded Tom songwriting royalties on 'Stay With Me,' after Sam and his team admitted there were definite similarities between the two songs.

According to Consequence of Sound, Tom and John Lynne both receive a 12.5% writing credit, and they're both listed as songwriters on the American Society of Composers, Authors and Publishers.

Once the similarities were pointed out to Sam and his team, they chose not to fight it, instead agreeing and settling with Tom and his camp. Sam's team says they were not previously familiar with the famous track, but recognized the comparable sounds. They released a statement that says, "Although the likeness was a complete coincidence, all involved came to an immediate and amicable agreement in which Tom Petty and Jeff Lynne are now credited as co-writers of ‘Stay With Me’ along with Sam Smith, James Napier and William Phillips.”

What do you guys think? Do you think the songs are similar enough to warrant the songwriting credit? Let us know!
