Police in Las Cruces have arrested a man accused of beating his girlfriend’s son who suffers from cerebral palsy.

The 14-year-old boy was taken to a Las Cruces hospital with injuries that included a swollen right eye, swollen cheek and lip, and bruising to his neck due to strangulation. Roberto Aguirre, 49, of Las Cruces is being charged with one count of intentional child abuse, a third-degree felony.

The boy’s mother put her son to bed and left Aguirre to watch over him while she went to a store. When she got back she discovered her son crying in bed and suffering from multiple injuries. Aguirre and the boy’s mother had been dating for over a year. Before the incident took place Aguirre had been at a bar drinking most of the afternoon and when she picked him up from the bar continued to drink at home.

Aguirre was booked into the Dona Ana County Detention Center, where he is initially being held without bond.
